Failure to Report Defective Toy Proves Costly | Colorado Product Liability Attorney

Thursday, October 20th, 2011

The U.S. Consumer Product Safety Commission (CPSC) reported that the toy company, Henry Gordy International, Inc. of Plainfield, N.J, has agreed to a settlement in a failure to report a product safety defect case concerning one of their toys. A toy gun known as the Auto Fire Target Set, included the plastic gun, plastic darts, and a small target. It was determined by the CPSC that the small plastic darts were a serious choking hazard for children. Even more disturbing, however, it was also determined that the Henry Gordy company knew of this potentially deadly risk and failed to report the issue or recall the product. Three deaths had been associated with the toy and the CPSC instantly took action. Henry Gordy agreed to pay the penalty of $1,100,000 but declined ultimate responsibility. Total recall of the product has been issued nationwide.

The accident occurred off of Highway 50 and sent both passengers to the hospital. The incident was reported by a group of tourists who were rafting in the Arkansas River when they witnessed the car upside down in the water. Pueblo Rollover Accident Leaves One Dead and One Seriously Injured | Pueblo Car Accident Attorney

Monday, June 20th, 2011

According to KKTV, a crash in Fremont County has left one man dead and another with serious injuries. The driver of a Ford Ranger apparently lost control of his vehicle while traveling on Highway 50, crashed into a sign, and then rolled multiple times. Sadly, the passenger died on the scene of the Pueblo car accident, while the driver was flown to St. Mary Corwin in Pueblo with serious injuries. Even though both of the vehicle occupants were wearing their seatbelts, rollover accidents are often tragic.

Vehicles, such as Sport Utility Vehicles, Jeeps, and pickup trucks, are involved in rollover accidents at a higher rate than other vehicles, due to their higher center of gravity. Since the SUV’s popularity has increased, so has the rate of rollover accidents. In fact, since 1991, the rate of rollover accidents has nearly doubled.

Tuesday, October 19th, 2010

According to an article posted by New First 5, more teens die in Colorado from car crashes than any other cause. In 2009, 38 Colorado teens lost their lives in automobile accidents. The Colorado State Patrol (CPS) wants to save as many teens as possible. The State Patrol encourages “parents to have their teens attend the Alive at 25 training or a driver safety course to help them be more knowledgeable about laws and the impact that poor driving choices will have on them.” The CPS offers the falling tips for teen drivers:

  1. Always wear your seatbelt
  2. Observe and obey posted speed limits
  3. Lower speed according to road conditions
  4. Never drink and drive
  5. Avoid distractions (cell phones, IPODs, radios) and pay attention to the road
  6. Know and observe the graduated driver’s license (GDL) laws

The CPS offers the falling tips for parents of teen drivers:

  1. Educate yourself about GDL laws

Trucker Pleads Guilty in Fatal Crash – Pueblo Personal Injury Attorney

Friday, September 24th, 2010

A trucker from Texas has pleaded guilty in causing the deaths of two women during a 2009 snow storm. According to 7News, Richard Widmier pleaded guilty to two counts of vehicular homicide on Wednesday in state court. Widmier was driving his tractor trailer eastbound on I-70 when it slammed into the back of a Jeep Liberty killing both women inside almost instantly. Investigators said that the Jeep was traveling in the far right lane at about 15 miles an hour due to white out conditions. Witness statements and accident reconstruction indicated that the tractor trailer was traveling between 56 and 63 miles an hour at the time of the collision.

When a large truck and a passenger vehicle collide, the results can be devastating. According to the “Large Truck Crash Causation” study by the National Highway Traffic Safety Administration and Federal Motor Carrier Safety Administration, when a passenger vehicle is in an accident with a tractor trailer, semi truck or an 18 wheel truck, the smaller vehicle’s passengers are more likely to be seriously injured or killed than those in the truck. The study reviewed 120,000 large truck accidents that occurred from April 2001 to December 2003. The study involved 241,000 total vehicles where injuries directly resulted from the accident finding that 44,097 crashes resulted in incapacitating injuries.
